Welcome to Oyino, the app discovery platform located at oyino.com. These Terms of Service (the “Terms”) govern your access to and use of the Oyino platform and services (the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.

Acceptance of Terms

By using the Platform, you affirm that you are at least the legal age required by your jurisdiction and have the capacity to enter into a binding agreement. Oyino reserves the right to modify these Terms at any time. We may provide notice of material changes through the Platform or other channels. Continued use after such notice constitutes your acceptance of the updated Terms. If you object to any changes, you must stop using the Platform.

Intellectual Property

All content and materials on the Platform, including but not limited to text, graphics, logos, images, software, and the overall design (collectively, “Oyino Content”), are owned or licensed by Oyino and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use Oyino Content solely for your personal, non-commercial purposes in connection with the Platform as intended by Oyino. You may not reproduce, distribute, modify, create derivative works, decompile, reverse engineer, or otherwise attempt to extract source code from the Platform, except as expressly permitted by law or with Oyino’s prior written consent. The Oyino name and logo are trademarks of Oyino and may not be used without Oyino’s prior written permission.

With respect to content you submit through the Platform (such as reviews or comments, collectively “User Content”), you retain ownership of that content. By submitting User Content, you grant Oyino a worldwide, non-exclusive, royalty-free license to display, reproduce, distribute, and publicly perform such content as part of the Platform’s operation and promotion. You represent that you own or have the necessary rights to submit User Content and that it complies with these Terms. Oyino does not endorse or guarantee the accuracy, legality, or reliability of User Content. You are solely responsible for any User Content you submit.

Third-Party Links and Apps Hosted on Google Play

The Platform serves as a gateway to applications that are hosted on third-party platforms, primarily Google Play. Oyino does not host, distribute, or store these apps on its own servers. When you choose to view or install an app through the Platform, you may be redirected to Google Play or another third-party service. Your use of those services is governed by Google’s terms and policies and the terms set by the app developers. Oyino does not guarantee the availability, functionality, safety, or continued support of any third-party app listed on the Platform, and we do not endorse or guarantee the quality or suitability of such apps. The inclusion of an app on the Platform is not an endorsement by Oyino or a certification by Google Play.

Disclaimer of Warranties; Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Oyino DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND SECURITY. Oyino DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK.

IN NO EVENT SHALL Oyino, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, OR ANY CONTENT OR SERVICES OBTAINED THROUGH THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL BE LIMITED TO THE GREATER OF THE AMOUNT PAID, IF ANY, BY YOU TO Oyino IN THE THREE MONTHS PRIOR TO THE CLAIM OR ONE HUNDRED DOLLARS, TO THE EXTENT PERMITTED BY LAW.
